LinkEdu.AI respects the intellectual property rights of others and expects its users to do the same. This policy outlines how we handle claims of copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.
1. Overview
If you believe that content on the LinkEdu.AI platform infringes on your copyright, you may submit a DMCA takedown notice to our designated copyright agent. Upon receipt of a valid notice, we will promptly investigate and, if appropriate, remove or disable access to the allegedly infringing material.
2. Filing a DMCA Notice
To file a DMCA takedown notice, send a written communication to our designated copyright agent at the contact information provided below. Your notice should be as detailed as possible to enable us to identify and locate the allegedly infringing material.
3. Notice Requirements
A valid DMCA notice must include the following:
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or a representative list if multiple works are involved.
- Identification of the infringing material: A description of the material you claim is infringing and its location on the Platform, including specific URLs or sufficient detail for us to locate it.
- Your contact information: Your name, mailing address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
4. Counter-Notice Process
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notice to our designated copyright agent. A valid counter-notice must include:
- Your name, address, telephone number, and email address.
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- A statement consenting to the jurisdiction of the federal court in the Commonwealth of Virginia and that you will accept service of process from the party who submitted the original DMCA notice.
- Your physical or electronic signature.
Upon receiving a valid counter-notice, we will forward it to the party who submitted the original notice. If the original complainant does not file a court action within 10 business days, we may restore the removed material.
5. Repeat Infringer Policy
In accordance with the DMCA, LinkEdu.AI maintains a policy of terminating the accounts of users who are found to be repeat copyright infringers. We will terminate any user's access to the Platform if, under appropriate circumstances, the user is determined to have repeatedly infringed the copyrights of others.
